GENERAL TERMS

We reserve the right to change, expand, and improve the App, modify the App`s user interface, add new features and functions, available both on a free and paid basis, from time to time and without prior notice to you. If we do so, once you start using such new features or pay for the relevant subscription you agree to follow this Agreement. We may also, at any time, cease to continue operating part or all of the App or selectively disable certain features of the App or cease providing any other Service partly or in full. Your use of the App does not entitle you to the continued provision or availability of the App. Any modification or elimination of the App or any particular features will be done in our sole and absolute discretion and without an ongoing obligation or liability to you.

Though we do our best to give you credible and verified information only, please note that your use of our Services is always subject to our medical and liability disclaimers, as far as we are not a healthcare organization and you are solely liable for your health.

USER CONTENT

By submitting any data, text, their selection and arrangement, and any other materials to the Service (hereinafter “User Content”), you hereby grant to CareU a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use User Content to the extent necessary for CareU to operate and maintain the Service to you and other users.

All User Content is the sole responsibility of the person from whom the User Content originated. Thus, users are responsible, and CareU is not responsible for any files users upload, post, or otherwise make available.

CareU may or may not regulate User Content and does not guarantee the accuracy, quality, or integrity of any User Content posted via the CareU application. By using the Service you acknowledge and accept that you may be exposed to material you find offensive or objectionable. You agree that CareU will not under any circumstances be liable for any User Content, including, but not limited to, errors in any User Content, or any loss or damage incurred by use of the User Content.

You represent and warrant that User Content you transmit or submit is original to you and that you exclusively own the rights to such content, including the right to grant all of the rights and licenses in these Terms without CareU incurring any third-party obligations or liability arising out of its exercise of such rights and licenses.

CareU reserves the right to remove and permanently delete any User Content from the Service with or without notice for any reason or no reason. You may notify CareU of any User Content that you believe violates these Terms, or other inappropriate user behavior, by emailing [email protected].

END USER LICENSE AGREEMENT

By using our Services, you undertake to respect our intellectual rights (intellectual rights related to the App's source code, UI/UX design, Services` content material, copyright and trademarks, hereinafter referred to as the "Intellectual Property Rights)" .

As long as you keep using the App and/or Services, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, non-assignable, and revocable right to download, access and use the App and/or access and use our Services pursuant to this Agreement.

You may use our Services solely for your own non-commercial purposes. You are bound to respect the copyrighted material within the Services, you cannot sell pictures available in the App.

The source code, design and content, including information, photographs, illustrations, artwork and other graphic materials, sounds, music or video (hereinafter the "Works") as well as names, logos and trademarks (hereinafter "Intellectual Property ") within the Services are protected by copyright laws and other relevant laws and/or international treaties, and belong to us and/or our partners, as the case may be.

hese Works and Intellectual Property may not be copied, reproduced, retransmitted, distributed, disseminated, sold, published, broadcasted, or circulated, whether in whole or in part, unless expressly permitted by us and/or our partners, as the case may be.

We will not hesitate to take legal action against any unauthorized use of our trademarks, names or symbols to protect and restore our rights. All rights not expressly granted herein are reserved. Other product and company names mentioned herein may also be the trademarks of their respective owners.

To avoid any doubt, we own all the text, images, photos, audio, video, software, code, and all other forms of data or communication that we create and make available in connection with the App, including but not limited to visual interfaces, interactive features, graphics, design, excluding User Content. Except as expressly and unambiguously provided herein, we do not grant you any express or implied rights, and all rights in and to the App, Works and Intellectual Property are retained by us and/or our partners as the case may be.

MEDICAL DISCLAIMER

You are solely responsible for your own health. The App are offered for educational and entertainment purposes only, and in no way intends to diagnose, cure, or treat any medical or other condition or to be a substitute for professional medical care. The App is not a clinical pulse oximeter. If knowing your pulse rate (heart rate) is critical to your health, you need to have your pulse taken by a medical professional.

Our Services and the App cannot and do not guarantee health-related improvements or outcomes. Your use of the Services and any information, predictions, or suggestions provided in the Services are at your sole risk. We make no representation or warranty of any kind as to the accuracy of data, information, estimates, and predictions that we may provide to you through the App and you agree and understand that the App is not intended to match or serve the same purpose as a medical or scientific device or healthcare provider.

USE OF CareU BY MINORS

You must be 18 years of age, or the age of majority in your province, territory or country, to sign up as a registered user of the Products. Individuals under the age of 18, or the applicable age of majority, may view the audiovisual content displayed in the Products only with the involvement and consent of a parent or legal guardian, under such person's account, and otherwise subject to these Terms.

REMENTE PREMIUM

This section only applies when you purchase and/or subscribe to CareU Premium or other paid products. By paying the subscription fee you get access to CareU Premium during the time your subscription is valid, subject to these Terms.

All subscriptions with CareU Premium are paid in advance. You may at any time terminate a renewal of your subscription, in which case your subscription will still be valid for the subscription time you have already paid for.

If you have subscribed to CareU through the use of Apple App Store, you can only cancel your subscription through the use of its service. Subscription fees can be found in the mobile application. CareU reserves the right to change the subscription fees from time to time.

For the purposes of CareU's Premium Lifetime subscription, Lifetime equals 100 years or until the date CareU ceases to commercially offer the Services.

All payments handled by Apple, such as in-app purchases, can only be refunded by Apple and with Apple's consent. Default in payment shall not be deemed as a termination of a CareU Premium subscription.

Subscriptions automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period.

The account will be charged for renewal within 24-hours prior to the end of the current period, and identify the cost of the renewal.
